Minutes of the Special City Council Meeting - 2003 Truth in Taxation Public Hearing of the City of Proctor, Minnesota, St. Louis County, held in the Community Center, Council Chambers, 100 Pionk Drive, Monday, December 2, 2002, 6:00 p.m.

MEMBERS PRESENT: Councilors Dick Kieren, Phil Larson, Tom Lavato, Deputy Mayor Benson

MEMBER ABSENT: Mayor Jim Rohweder

Others in attendance included City Administrator John Foschi, City/PUC Accountant Stephen Anderson, Administrative Secretary, Terry Martin.

City Attorney John Bray arrived at 6:04 p.m.

Total Budget and Property Taxes

The Proctor City Council will hold a public hearing on its budget and on the amount of property taxes it is proposing to collect to pay for the costs of services the city will provide in 2003.

SPENDING: The total budget amounts below compare the city's 2002 total actual budget with the amount the city proposes to spend in 2003.

City Administrator noted parcel code identification cards mailed to property owners by St. Louis County read the incorrect date for Proctor?s 2003 Truth-in-Taxation public hearing.

Council acknowledged all Governmental Fund Budgets as presented in their packets - General Fund Department Summary, Downtown Redevelopment Fund, Tourism Department Detail - including all other funds which were given Council in their November 18th meeting packets.

City Administrator reviewed the Governmental Fund Budgets and asked for public input/comments (including the General Fund by department).

It was noted the Minnesota Department of Revenue total special levies (Bonded Indebtedness, Certificates of Indebtedness & PERA (Employer Contribution) - $261,175.00; payable 2003 levy limitation - $317,568.00; with sum of approved special levies - $578,743.00.

Noted a $22,026.00 (7.45%) increase in General Fund levy, and an overall 5.4% net levy increase.

Motion by Kieren, seconded by Lavato and carried: To further discuss the Year 2003 Governmental Fund Budget, (including General Fund Budget) and Property Tax Levy by continuing this as a subsequent hearing at the next regularly scheduled City Council meeting on Monday, December 16, 2002 starting at 6:00 p.m. Mayor Rohweder: absent. Minutes of the regular City Council Meeting of the City of Proctor, Minnesota, St. Louis County, held in the Community Center, Council Chambers, 100 Pionk Drive, Monday, December 2, 2002, 6:22 p.m.

Motion by Kieren, seconded by Lavato and carried: Upon the recommendation of Planning & Zoning Commission, to approve the rezoning of Lots 1-18, Abitare Addition, from R-1-b to R-2 contingent upon applicant?s filing of Abitare?s final plat plan with St. Louis County. Deputy Mayor Benson: abstained. Mayor Rohweder: absent. M-413-02-401

Motion by Kieren, seconded by Larson and carried: To accept final draft of the Proctor Comprehensive Plan (dated December 2002) as presented (and on file at City Hall) and recommended by Planning & Zoning Commission. Mayor Rohweder: absent. M-414-02-401

Motion by Benson, seconded by Kieren and carried: Upon recommendation of Planning & Zoning Commission, to approve the City to begin the process (including authorization of an educational meeting of all City officials) to work with Sea Grant Program and allow them to prepare a Proctor-specific non-point pollution education for municipal officials program. Motion by Lavato, seconded by Benson and carried: To authorize Planning & Zoning Commission to hold a public hearing on proposed changes to City Code §802.10, Semi-Parking, taking any public input. Mayor Rohweder: absent. M-416-02-401

Motion by Kieren, seconded by Lavato and carried: To accept City Attorney?s recommendation for change to City Code §1001.08 and hold a First Reading which will add Subd. 3, Multiple Hearings. Mayor Rohweder: absent. M-417-02-401

Motion by Lavato, seconded by Larson and carried: Upon recommendation of Planning & Zoning Commission, approve abatement notice and order for 420 Ugstad Road (as on file at City Hall). Mayor Rohweder: absent. M-418-02-401

Motion by Lavato, seconded by Larson and carried: To approve the Governmental Fund payroll for the period ending November 17, 2002 in the amount of $32,781.08 and the Liquor Fund payroll for the period ending November 17, 2002 in the amount of $2,691.05. Mayor Rohweder: absent. M-419-02-4057

Motion by Benson, seconded by Kieren and carried: To approve Change Order #20 in the amount of $8,235.84 to Reuben Johnson & Sons, Inc. Mayor Rohweder: absent. M-420-02-401

Motion by Kieren, seconded by Lavato and carried: To approve City of Proctor?s participation in Phase 2 - Duluth Area Bike Routes for signage/striping agreeing to locally match $5,340.00. Mayor Rohweder: absent. M-421-02-401

Motion by Kieren, seconded by Larson and carried: To approve City of Proctor?s participation and financial commitment in the Minnesota Coastal Water educational Grant. Mayor Rohweder: absent. M-422-02-401

Motion by Lavato, seconded by Benson and carried: To allow the City of Proctor?s participation in the League of Minnesota Cities NPDES Phase II Stormwater Guide Plan approving $3,000 fee to join. Mayor Rohweder: absent. M-423-02-401

Motion by Lavato, seconded by Kieren and carried: To accept the November 21, 2002 Proctor Economic Development Authority meeting minutes. Mayor Rohweder: absent. M-424-02-401

Motion by Lavato, seconded by Benson and carried: To accept the November 20, 2002 Street Committee meeting minutes. Mayor Rohweder: absent. M-425-02-401

Motion by Lavato, seconded by Kieren and carried: Upon the recommendation of Street Committee engage City Engineer to begin the process of a study for sewer replacement for the 200 block of Eighth Street. Mayor Rohweder: absent. M-426-02-401

Motion by Lavato, seconded by Larson and carried: To accept the November 21, 2002 Public Safety Committee meeting minutes. Mayor Rohweder: absent. M-427-02-401

Motion by Larson, seconded by Lavato and carried: To direct City Attorney to draft change to City Code §610 Subd. 2, Public Dancing - Hours, to read events shall terminate at 12:00 a.m. Mayor Rohweder: absent. M-428-02-401

Motion by Lavato, seconded by Benson and carried: To accept agreement between Pierce Manufacturing, Inc. and City of Proctor Fire Department for the purchase of a fire truck contingent upon recommended changes being made (as presented to Council in their packets). Mayor Rohweder: absent. M-429-02-401

Motion by Lavato, seconded by Kieren and carried: To authorize the City to apply for a grant for State funded alcohol-youth compliance checks. Mayor Rohweder: absent. M-430-02-401

Motion by Lavato, seconded by Larson and carried: To accept the resignation of Councilor Dick Kieren, effective December 31, 2002. Mayor Rohweder: absent. M-431-02-401

Motion by Kieren, seconded by Benson and carried: To accept the resignation of John McKagan from the Public Safety Committee. Mayor Rohweder: absent. M-432-02-401

Motion by Lavato, seconded by Kieren and carried: To approve the Governmental Fund bills in the amount of $41,591.68 and the Liquor Fund Bills in the amount of $16,558.82. Proposed Amendment to Proctor City Code §1001.08 Subd. 3 Variances; Multiple Hearings

Proctor City Code §1001.08 Subd. 3, Variances; Multiple Hearings, is hereby added to the City Code as follows:

Subd. 3 Multiple Hearings.

Subd. 3. Multiple Hearings, whenever multiple hearings relating to the same property take place on the same date as hearings required under this chapter, the applicant shall be obligated to pay only the highest applicable application fee.

This ordinance is effective upon publication in the official newspaper of the City and approval of Second Reading by Council.
