NOTICE OF MORTGAGE FORECLOSURE SALE

NOTICE IS HEREBY GIVEN, that default has occurred in conditions of that certain Mortgage, dated January 6, 2004, executed by Kenneth Lassard, a single person, as Mortgagor, to Proctor Federal Credit Union, a banking corporation, as Mortagee, and filed for record in the Office of the County Recorder in and for the County of St. Louis and State of Minnesota on January 23, 2004, as Document No. 00932298. The land described in the Mortgage is not registered. The original principal amount secured by the Mortgage was $110,000.00. No action or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof. All conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage as required by the Mortgage or applicable law, including the giving of Notices to the Mortgagor have been complied with by the Mortgagee; that there is due and claimed to be due upon said Mortgage, including interest to date hereof, the sum of $95,585.42, and that pursuant to the power of sale therein contained, said Mortgage will be foreclosed and the tract(s) of land lying and being in the County of St. Louis, State of Minnesota, described as follows, to-wit:

South 1/2 of Northwest 1/4 of Southwest 1/4, Section 26, Township 50, North of Range 16, West of the Fourth Principal Meridian.

will be sold by the Sheriff of said County at public auction on Tuesday, November 3, 2009, at 10:00 a.m. at the main office of the St. Louis County Sheriff, 100 North Fifth Avenue West, Duluth, Minnesota, to pay the debt then secured by said mortgage, and taxes, if any, paid by the mortgagee, on the premises, and the costs and disbursements allowed by law. The time allowed by law for redemption by the mortgagor(s), his personal representative or assigns is six (6) months from the date of said sale.

THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR’S PERSONAL REPRESENTATIVE OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
