Mayor Anderson called the meeting to order at 6:01 p.m.

MEMBERS PRESENT:

Mayor Stephen Anderson, Councilors Jake Benson, Tom Lavato, Shawn McGovern.

MEMBERS ABSENT:

Councilor Troy Foucault

OTHERS PRESENT:

The following motions were approved:

Motion by Lavato, seconded by McGovern and carried: To approve the Proctor City Council regular meeting minutes for July 6th, 2009; the Public Utilities Commission meeting minutes for June 8th, 2009; and the May 2009 Public Utilities Commission Income Statement. M-201-09-401

Motion by McGovern, seconded by Benson and carried: To approve the Proctor City Council Revised meeting Agenda for July 20th, 2009 with the addition of 7. C Public Hearing for playground and 7. D Request for a part-time Janitor. M-202-09-401

Motion by Lavato, seconded by McGovern and carried: To approve the Consent Agenda, pulling off items 1.B and 3.B. M-203-09-401

Motion by Benson, seconded by McGovern and carried: To suspend the agenda to hear from the audience. M-204-09-401

Motion by Lavato, seconded by McGovern and carried (Anderson-Abstain): To approve waiving the fees for the Dave Hylla Memorial excluding the state surcharge and costs of planning. M-205-09-401

Motion by McGovern, seconded by Lavato and carried (Benson-abstained): To allow alcohol on 3rd Avenue and possibly extend it to parts of 4th & 5th Streets, except for the family areas to be designated by the Lion’s Club. M-206-09-401

Motion by Lavato, seconded by McGovern and carried: To approve the Friends of Animals Humane Society Contract for Service as presented. M-207-09-401

Motion by McGovern, seconded by Benson and carried: To hold a public hearing for a boundless playground grant application at 6:00 p.m. August 3rd, 2009 prior to the regular City Council meeting. M-208-09-401

Motion by Benson, seconded by McGovern and carried: To approve the hiring of Val Sundquist for the part-time Janitor position. M-209-09-401

Motion by Lavato, seconded by McGovern and carried: To approve the payment of $43,189.47 for the General Funds (with the addition of a bill for Velosum (electronic ticketing) in the amount of $3,433.00) and Liquor Fund bills of $60,006.63. M-210-09-401, 481

Motion by McGovern, seconded by Lavato and carried: To adjourn the Proctor City Council Meeting at 7:23 p.m. M-211-09-401

Motion by Lavato, seconded by Foucault and carried: To approve the Proctor City Council regular meeting minutes for June 15th, 2009. M-188-09-401

Motion by Lavato, seconded by Benson and carried: To approve the Proctor City Council meeting agenda as presented for July 6th, 2009. M-189-09-401

Motion by Lavato, seconded by Foucault and carried: To approve the Proctor City Council Consent Agenda, pulling off items 3B, 3D and 4B. M-190-09-401

Motion by Benson, seconded by McGovern and carried: To suspend regular agenda to hear from the audience. M-191-09-401

Motion by Lavato, seconded by McGovern and carried: To approve the Proctor Planning and Zoning meeting minutes for June 22nd, 2009 as presented. M-192-09-401

Motion by Lavato, seconded by Foucault and carried: To accept the meeting minutes of the Tourism Committee for June 16th, 2009. M-193-09-401

Motion by Lavato, seconded by Foucault and carried: To certify the Garbage assessment as written. M-194-09-401

Motion by Anderson, seconded by Benson and carried (Foucault-Abstained): To authorize the hiring of one Full-time Police Officer to replace the Proctor Police Officer that resigned. M-195-09-401

Motion by Lavato, seconded by Benson and carried (Foucault- Abstained): To authorize Civil Service to hire one On-call (Part-time) Police Officer. M-196-09-401

Motion by Lavato, seconded by McGovern and carried: To authorize holding a 5K Hylla Memorial run on the morning of Hoghead (August 15th, 2009) as long as Parendo coordinates this activity with the Lion’s club. M-197-09-401

Motion by Foucault, seconded by Lavato and carried: To amend the agreement with Oliver to remove the age restriction at Botanical Gardens. M-198-09-401

Motion by Lavato, seconded by Benson and carried: To approve the General Fund Bills list dated July 1, 2009 in the amount of $136,255.95 and the Liquor Fund bills list dated July 1, 2009 in the amount of $39,736.05. M-199-09-401, 481

Motion by Foucault, seconded by McGovern and carried: To adjourn the Proctor City Council meeting at 8:35 p.m. on July 6th, 2009. M-200-09-401

The following Resolutions were adopted:

Resolution No. 06-09 (combined refunding on equipment certificates)

Resolution No. 07-09 (Support of a request to have the Proctor Spur Trail added to the 2010 Capital Appropriation)

Resolution No. 08-09 (Support of a request to have the Kirkus Street project added to the 2010 Capital Appropriation)

Resolution No. 09-09, Resolution Making A Declaration Of Official Intent Under U.S. Treasury Regulations Section 1.150-2

803.01 Bicycles

803.01 Bicycle License Required. No person shall ride or propel a bicycle, as defined by Minnesota Statute 168C.02 upon any street or highway within the City without first having secured a license therefore pursuant to Minnesota Statute Chapter 168C and affixing the license issued thereunder to said bicycle.
