SUMMARY OF THE PROCEEDINGS OF THE REGULAR CITY COUNCIL MEETING

The following motions were approved:
Motion by Lavato, seconded by Kieren and carried: To approve the July 5, 2005 City Council regular meeting minutes; June 13, 2005 Public Utilities Commission regular meeting minutes, and PUC Income Statement for period ending May 31, 2005. M-301-05-401
Motion by Lavato, seconded by Benson and carried: To approve the agenda to include 2.C Recommendation of code change; and 7.E. Administrative tickets M-302-05-401
Motion by Benson, seconded by Lavato and carried: To suspend the agenda to go to the audience. M-303-05-401
Motion by Lavato, and seconded by Benson and carried: To change the date of Council’s second meeting in August from the 15th to the 16th to accommodate the Chamber of Commerce’s golf scramble. Meeting to be held at the regular time. M-304-05-401
Motion by Brenna, seconded by Lavato and carried: To approve rezoning of lands, Auditors Plat No. 16 Proctor, Lots 26 Thru 29, to R-3 for assisted living buildings (with the need for a conditional use permit) M-305-05-401
Motion by Councilor Larson, second by Mayor Kieren and carried: To approve the Government Fund payroll for period ended July 10, 2005 in the amount of $32,369.18 and Liquor Fund payroll for period ended July 10, 2005 in the amount of $3,068.21. M-306-05-4057
Motion by Larson, seconded by Brenna and carried: Westgate Boulevard project contract with Plaunt Company accepted by Council conditioned upon LHB approval (this includes HDPE pipe) M-307-05-401
Motion by Kieren, seconded by Brenna and carried: Almac Drive properties already hooked-up to sewer through private or public hook-up will not be charged a City tapping fee again M-308-05-401
Motion by Larson, seconded by Brenna and carried: To put Birchwood Avenue repair project to bid after LHB input M-309-05-401
Motion by Kieren, seconded by Benson and carried: To accept the Proctor Fire Relief Association By-Law changes (dated July 12, 2005 and on file at City Hall). M-310-05-401
Motion by Lavato, seconded by Brenna and carried: To accept the 13th Street project feasibility study extending curb to Third Avenue and direct LHB to draw-up plan and ask engineer to examine rolled curb as an option M-311-05-401
Motion by Benson, seconded by Brenna and carried: To request jointly with the Chamber of Commerce, that CN donate an ore car and access to sandblasting, primer and paint for the ore car that would then be located with the Mallet and Caboose. M-312-05-401
Motion by Kieren, seconded by Brenna and carried: To carry out court order at 507 Fourth Street. M-313-05-401
Motion by Benson, seconded by Brenna and carried: To accept Police Supervisor’s Union Contract amended to include Article V - Wages of Deputy Chief (on file at City Hall). M-314-05-401
Motion by Benson, seconded by Brenna and carried: To approve the General Fund bills - less Utility Systems of America invoice for a total of $64,538.07 and Liquor fund for a total of $22,906.42 M-315-05-401,481

Proposed Amendment to Proctor City Code
§1002.09 Subd. 3 (C) (12) “C-1” Retail District,
Permitted Conditional Uses
Proctor City Code §1002.09 Subd. 3 (C) (12), is hereby added to the City Code as follows:
(C) Permitted Conditional Uses. The following may be permitted in the “C-1” Retail District as conditional uses:
(12) Printing and finishing of textiles and fibers into fabric goods.

This ordinance is effective upon Council’s approval at a Second Reading after publication in the official newspaper of the City.

Proposed Amendment to Proctor City Code
§610.04 Street Dances
The following Resolution was adopted:
Resolution No.14-05, The City of Proctor, Proctor City Council - Consolidated Plan/Action Plan application for the Community Development Block Grant (CDBG) program, and other community planning and development programs (Fourth Street (Boundary Avenue to 2nd Avenue) sanitary sewer, water main and replacement and street reconstruction project)
The foregoing is only a summary of the proceedings of the regular City Council meeting described above.
