NOTICE IS HEREBY GIVEN that, under and by virtue of a Judgment entered in the above entitled action on the 20th day of January, 2009, a certified transcript of which has been delivered to me, I undersigned Sheriff of said St. Louis County, will sell at public auction to the highest bidder for cash on March 31, 2009, at 10:00 a.m., at the St. Louis County Sheriff’s Department, 100 North Fifth Avenue West, Room 103, Duluth, Minnesota, the premises and real estate described in said Judgment, to-wit:
Parcel 1:
Government Lot 6, Section 8, Township 51, North of Range 20, West of the Fourth Principal Meridian, according to the United States Government Survey thereof.
Tax parcel identification number: 360-0010-01350.
Parcel 2:
That part of Government Lot 4, lying southerly of the Savannah River, in Section 8, Township 51, North of Range 20, West of the Fourth Principal Meridian, according to the United States Government Survey thereof.
Tax Parcel Identification number: 360-0010-01385.
Parcel 3:
Government Lot 5, Section 8, Township 51, North of Range 20, West of the Fourth Principal Meridian, according to the United States Government Survey thereof.

Parcel 4:
All that part of the Southeast Quarter of the Southwest Quarter and the Northeast Quarter of the Southwest Quarter lying and being northeasterly of the Great Northern Railroad right-of-way and Highway No. 2 right-of-way, Section 8, Township 51, North of Range 20, West of the Fourth Principal Meridian, according to the United States Government Survey thereof.
EXCEPT that part described in final certificate filed in Book 835 of Deeds, page 201, on August 17, 1948, taken by State of Minnesota for highway purposes and except all rights of record created in favor of Duluth and Winnipeg Railroad Company by deed recorded in Book 31 of Deeds, page 574 on January 25, 1889.

Beginning at the southwest corner of said Northwest Quarter of the Northwest Quarter; thence North, assumed bearing, along the west line of said Northwest Quarter of the Northwest Quarter 660.00 feet; thence East 660.00 feet; thence South 660.00 feet, more or less, to the south line of said Northwest Quarter of the Northwest Quarter, thence westerly, along said south line 660.00 feet, more or less, to the point of beginning. Containing 10.0 acres, more or less, and subject to an easement over State Trunk Highway No. 73 on the west and any other easements of record, if any.

Said sale will be made to satisfy the sum of $85,956.92 and $2,500.00 in attorney’s fees found and adjudged to be due by said judgment, together with costs and expenses of sale.
The time allowed by law for redemption by Mortagors or Mortgagors’ personal representatives or assigns is twelve (12) months after the date of sale.
THE RIGHT TO VERIFICATION OF THE DEBT AND IDENTITY OF THE ORIGINAL CREDITOR WITHIN THE TIME PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.
