REGULAR PROCTOR CITY COUNCIL MEETING

December 21, 2009

Mayor Anderson called the meeting to order at 6:01 p.m.

MEMBERS PRESENT: Mayor Stephen Anderson, Councilors Tom Lavato, Jake Benson and Troy Foucault

MEMBERS ABSENT: Councilor Shawn McGovern

OTHERS PRESENT: City Attorney John Bray, City Administrator Jim Rohweder, Katie Cresap, Jon Olsen, David Riddle, Scott Sandquist, Zach Raskovich, Glen Johnson, Bob Wilke

The following motions were approved:

Motion by Lavato, seconded by Foucault and carried: To approve the December 7, 2009 Proctor City Council regular meeting minutes; November 9, 2009 Proctor Public Utilities regular meeting minutes; PUC Income Statement/Budget 2009-2010; October 2009 PUC Income Statement. M-327-09-401

Motion by Lavato, seconded by Foucault and carried: To approve the December 21, 2009 regular Proctor City Council meeting agenda with the addition of items 6E – Ugstad Road Project and 6F – Wine License M-328-09-401

Motion by Lavato, seconded by Foucault and carried: To approve the Consent Agenda. M-329-09-401

Motion by Foucault, seconded by Benson and carried: To suspend the regular agenda to hear from the audience. M-330-09-401

Motion by Lavato, seconded by Anderson and carried: To approve the change in date for the meeting with Midway Township Board. The new meeting date is January 21, 2010 at the Augustana Church. M-331-09-401

Motion by Foucault, seconded by Lavato and carried: To approve the Final Levy Certification on December 21, 2009. M-332-09-401

Motion by Foucault, seconded by Lavato and carried: To grant the Conditional Use Permit for the Mediacom building with the following conditions: there will only be one 8 x 10 hut allowed on the property, Mediacom will provide adequate screening around the hut, and Mediacom will maintain the property around the hut (i.e. cut the grass). M-333-09-401

Motion by Lavato, seconded by Foucault and carried: To authorize the City Attorney to write a letter stating that he has reviewed the Ugstad Road Project. M-334-09-401

Motion by Foucault, seconded by Benson and carried: To approve the 2010 Liquor License renewals contingent upon the bars having all of the necessary paperwork completed by December 31, 2009. This approval will not apply to outdoor activities scheduled for Hoghead week. M-335-09-401

Motion by Lavato, seconded by Foucault and carried: To authorize the City Attorney to write a letter of opposition in regards to the Pre-arraignment Jail Use Charges. M-336-09-401

Motion by Benson, seconded by Foucault and carried: To approve the 2010 towing license application for Troy’s Amoco/DeWall Service Center. M-337-09-401

Motion by Lavato, seconded by Foucault and carried: To direct the City Attorney to draft an ordinance allowing the Police Department to perform thorough background checks on applicants for Liquor Licensing. M-338-09-401

Motion by Lavato, seconded by Benson and carried: To accept the staff recommendation for the New Credit Card. M-339-09-401

Motion by Foucault, seconded by Anderson and carried: To approve the agreement for Professional Services between the City Of Proctor and the South St. Louis Soil and Water Conservation District. M-340-09-401

Motion by Lavato, seconded by Foucault and carried: To close the regular Proctor City Council meeting at 8:09 p.m. and move into a Closed Session to discuss a buyout offer for an employee. M-341-09-401

Motion by Lavato, seconded by Benson and carried: To return to an Open Session to complete the meeting. M-342-09-401

Motion by Foucault, seconded by Lavato and carried: To approve the payment of the Liquor Fund Bills List for $27,925.59 and the General Fund Bills list for $26,181.39. M-343-09-401, 481

Motion by Foucault, seconded by Lavato and carried: To adjourn the meeting at 8:23 p.m. M-344-09-401
